Breach of Contract
Just like other types of business contracts, sports contracts are legally binding agreements that require both parties to perform specific duties. If either party fails to fulfill its duties, then there is a breach of that contract. Examples of breach of sports contracts include: Failing to perform, failing to produce the expected results, failing to play, Interfering with other contracts, or attempting to prevent the recruitment of other athletes or coaches
Recovering Compensation for Contract Breaches
When it comes to compensation for breach of a sports contract, the party with the grievance can attempt to recover monetary damages and/or specific performance. Monetary damages can include loss of wages, loss of earning capacity, attorney fees, and other consequential damages.
Specific performance is awarded when a court rules that a term specified in the contract has to be completed. This type of compensation can be recovered if a team or sponsor falls to commit to the various non-monetary obligations they promised to fulfill.
