What is California Penal Code § 647?
California PC § 647 encompasses several laws for the crime of disorderly conduct. Various actions – including lewd acts and “squatting” – are included in this statute.
California Penal Code § 647(f)
California Penal Code § 647(f) is California’s drunk in public law and refers specifically to the offense of being under the influence of alcohol or drugs in public. This charge is sometimes referred to as drunk and disorderly, drunk in public, or public intoxication.
Being drunk in public is not enough to warrant an arrest or criminal charge. According to PC 647(f), persons can be charged with a crime if they:
- Are in a condition where they are unable to exercise care for their own safety or the safety of others; or
- Interferes with or obstructs the free use of a street, sidewalk, or other public way.
What are the Punishments if Convicted of PC 647(f)?
PC 647(f) is a misdemeanor offense punishable by up to $1,000 in fines, up to six months imprisonment, or both.
